H-2B Cap Reached: No More H-2B Visas Available For Work Prior to October 1, 2008 The H-2B (temporary worker) cap for the second half of fiscal year 2008 was reached as of January 2, 2008. Employers must now wait until October 1, 2008 for new H-2B employees to begin work. Employers hoping to hire new H-2B workers for an October 1, 2008 start date may file new H-2B temporary labor certification applications with the State Workforce Agency no earlier than June 3, 2008.
