Every employer in the United States is required to confirm the identity and employment authorization of all workers by completing an “I-9” form for each employee.  The Immigration Reform and Control Act of 1986 (“IRCA”) established this requirement, while simultaneously imposing a variety of anti-discrimination provisions.  Employers must walk the fine line between verifying the employment authorization of workers, without engaging in unlawful citizenship or nationality discrimination.
